Upper Playground & Juxtapoz Magazine's “São Paulo Super Summer” Contest
NO PURCHASE NECESSARY TO ENTER THE CONTEST
CONTEST IS VOID WHERE PROHIBITED
By entering the contest you fully and unconditionally agree to all terms of these Official Rules and the decisions of Upper Playground Enterprises, Inc. (Upper Playground) and any Sponsor(s), which are final and binding on all matters relating to the contest.
ELIGIBILITY: The Sweepstakes is open only to current legal residents of the 50 United States and the District of Columbia who are eighteen (18) years of age or older at time of entry. Employees of Upper Playground, Juxtapoz Magazine and their respective parents, subsidiaries and affiliates and each of their officers, directors, shareholders, employees, advisors, accountants, attorneys, assignees, agents, licensees, representatives and any other person or entity associated with this Contest, including any advertising and promotional agencies, (collectively, “Contest Entities”), and their immediate family members (defined as parent, spouse, child, siblings and grandparents) are NOT eligible to win. Void outside the 50 United States and the District of Columbia and Canada or where prohibited by law. All federal, state, provincial and local laws and regulations apply. By entering any Contest, entrants agree to waive any and all claims against Contest Entities for personal injury, damage or loss of any kind which may result from participation in the Contest or from the receipt, enjoyment, ownership or use of any prize.
HOW TO ENTER. NO PURCHASE NECESSARY. To enter, log on here. Fill out the electronic form and submit it in accordance with the on-screen instructions during the Contest Period noted on the entry form page. One entry per person. All entries must be received by 11:59 p.m. P.S.T on Tuesday, July 7, 2009, to be eligible for the drawing. Entries generated by automated means will be disqualified. All entries become the property of Upper Playground. Alternate entry may be made by providing all the information required to be filled out on the form on a sheet of 8.5inch by 11 inch paper and mailing the same to “São Paulo Super Summer Contest” Upper Playground 1661 Tennessee Street, Unit 3F, San Francisco, CA 94107.
PRIVACY POLICY: Entrant information provided on the electronic form will be used by Upper Playground or the Sponsor(s) in connection with the Contest. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified.
PRIZE: The prize includes round trip plane tickets for two to São Paulo, Brazil; 4 nights at a hotel in São Paulo, Brazil; Day tour of São Paulo with local artists William and Herbert Baglione; Private tour of the Choque Cultural (Culture Shock) Gallery; and a $500 Upper Playground Online Store Gift Certificate. (Approximate Value 5,000 USD) Actual value may vary. Prizes are nontransferable and no cash substitution is allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value of the Approximate Value if advertised prize (or portion of prize) is unavailable for any reason. All federal, state, and local taxes are the sole responsibility of the winner. All other expenses and costs not expressly listed above are the winner’s sole responsibility. Airline carrier's and hotel regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Winner and his/her travel companions must possess valid travel documents (i.e., valid government issued photo ID, passport, visa, etc.) in order to travel. Grand Prize winner and his/her travel companions must travel together on the same itinerary. Trip must be taken during the time period scheduled. Otherwise the prize will not be awarded. Guest of the winner, if a minor, must travel with the minor’s legal guardian, who must be the winner.
DRAWING AND NOTIFICATION: Winner will be selected in a random drawing from all eligible entries received, on or about ten (10) business days after the last day to submit entries, by Upper Playground or Sponsor(s), whose decisions will be final. Winner will be notified by e-mail and/or by phone on or about ten (10) business days after the winner is selected. If Sponsor or its designee is unable to contact potential Winner by e-mail or phone (using the contact information provided at the time of entry) and/or if the potential Winner fails to respond to notification within two (2) business days of issuance, the potential Winner will be disqualified and forfeit his or her right to a prize, and an alternate Winner will be selected.
WINNER'S AFFIDAVIT: The winner may be required to sign an Affidavit of Eligibility and Liability/Publicity release, a written version of these Rules and any additional documentation, waivers and releases that may be required (collectively, “Affidavit”). The Affidavit may require that each Winner provide his/her Social Security Number for tax purposes due to potential payments from Sponsor to the Winner and will be used solely for tax purposes. The requirement for a publicity release shall be void where prohibited. By acceptance of the prize, the Winner releases Sponsor from any and all liability for injuries, damages or expenses sustained in connection with the Contest or with the receipt, ownership or use of the prize. Failure to sign the Affidavit may cause the Winner to forfeit the prize. Failure of the Winner to respond to notification and/or to complete and return the Affidavit within one week after sent to such Winner will be deemed a forfeiture of the prize and an alternate Winner will be selected from the eligible entries.
LIABILITY & RELEASE: Entrants agree to release and hold harmless Upper Playground and Sponsor(s), their respective affiliates, divisions, subsidiaries, parent and related companies, advertising, promotional, fulfillment and marketing agencies and the employees, directors, officers and shareholders of each from and against any claim or cause of action whatsoever arising out of participation in the Contest or receipt or use of any prize, including, but not limited to: intervention in the Contest; technical errors related to computers, servers, networks, etc.; printing or typographic errors; lost, late, misdirected, or undelivered / undeliverable mail; errors in the administration of the Contest or the processing of entries; or injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt of any prize. Entrant further agrees that in any cause of action, liability will be limited to the cost of entering and participating in the Contest, and in no event shall the released parties above be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. The Sweepstakes and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of California in the U.S., without regard to conflicts of law provisions. Entrants submit to exclusive personal jurisdiction in California and agree that any dispute shall be brought in the state and federal courts in California in the U.S. Neither Upper Playground nor Sponsor(s) assume any responsibility for any schedule changes in the Contest timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Contest schedule. Contest Entities reserve the right to cancel, modify, or suspend this Contest.
